Terms and Conditions

Agreement to these Terms

These Terms govern your use of pickqrcode.com and related services (the “Service”), provided by Honest Abe Marketing under the Pick QR Code name. By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

U.S. service and eligibility

The Service is directed to users in the United States. You must be at least 13 years old to use it. If you are under the age of legal majority where you live, you may use the Service only with permission from a parent or legal guardian. You may not use the Service if applicable law prohibits you from doing so.

What the Service does

Pick QR Code provides tools for creating, styling, testing, and downloading QR codes, plus optional templates and hosted pages. Most standard QR codes are generated locally in your browser. Features may change, be limited, or be discontinued, and we do not promise that any hosted page or QR destination will remain available forever.

Your responsibilities

  • Verify every QR code and destination before printing, publishing, or distributing it.
  • Keep destination links, Wi-Fi details, event details, and contact information accurate.
  • Use sufficient print size, contrast, quiet zone, and testing for the intended environment.
  • Obtain all permissions needed for content, logos, links, and personal information you use.
  • Comply with applicable laws, platform rules, and third-party terms.

You are solely responsible for the content encoded in a QR code, where it leads, how it is distributed, and any consequences of its use. Do not rely on the Service for emergency, safety-critical, medical, payment-security, or other uses where a scanning or availability failure could cause harm.

Acceptable use

You may not use the Service to:

  • Break the law, facilitate fraud, impersonate others, or mislead people about a destination.
  • Distribute malware, phishing pages, spam, unlawful tracking, or harmful code.
  • Infringe intellectual property, privacy, publicity, or other rights.
  • Publish illegal, abusive, exploitative, or sexually explicit content involving minors.
  • Bypass limits, probe security, disrupt the Service, scrape it excessively, or automate abusive traffic.

We may block, remove, or restrict content or access when reasonably necessary to protect users, the Service, or third parties, or to comply with law.

Your content

You retain ownership of content you submit. For content you ask us to host, you grant us a nonexclusive, worldwide, royalty-free license to store, reproduce, format, transmit, and display it only as needed to provide, secure, and improve the Service. You represent that you have the rights needed to grant that license. Hosted content may be public to anyone with the link, so do not submit secrets or sensitive personal information.

Our intellectual property

The Service, branding, software, original design, and site content are owned by us or our licensors and protected by law. These Terms give you a limited, revocable, non-transferable right to use the Service for its intended purpose. They do not transfer ownership of the Service or our marks.

Third-party services and links

QR codes and pages may point to third-party sites, and the Service may rely on third-party providers. We do not control or endorse third-party content, availability, security, or practices. Your dealings with third parties are between you and them and may be governed by separate terms.

Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, or that every QR code will scan in every condition.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

Limitation of liability

To the fullest extent permitted by law, Pick QR Code, Honest Abe Marketing, and their owners, personnel, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, business, or QR distribution costs, arising from the Service. Our total liability for all claims will not exceed the greater of $100 or the amount you paid us for the Service during the 12 months before the claim.

These limits do not apply where prohibited by law.

Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless Pick QR Code and Honest Abe Marketing from third-party claims, damages, and reasonable costs arising from your content, your misuse of the Service, or your violation of these Terms or another person’s rights.

Disputes and governing law

Before filing a claim, please email us and allow 30 days to try to resolve it informally. These Terms are governed by applicable U.S. federal law and the laws of the state where Honest Abe Marketing has its principal place of business, without regard to conflict-of-law rules. Courts with jurisdiction over that principal place of business will be the exclusive venue, unless applicable law requires otherwise.

General terms

If a provision is unenforceable, it will be limited to the minimum extent needed and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, sale, or transfer of the Service. These Terms and the Privacy Policy are the entire agreement about the Service.

Changes and contact

We may update these Terms by posting a revised version and effective date. Continuing to use the Service after an update means you accept the revised Terms to the extent permitted by law. Questions, notices, and infringement reports may be sent to admin@honestabemarketing.com.
